    Queen’s Speech 2021: UK-EU relationship

    The UK-EU Trade and Cooperation Agreement formally entered into force on 1 May 2021, having applied provisionally since the start of the year. However, there are still aspects of the post-Brexit relationship between the UK and the EU that remain to be settled or fully implemented.     Audiovisual Media Services (Amendment) Regulations 2021

    The Audiovisual Media Services Regulations 2020 transposed a revised EU directive into UK law. The current amendment regulations would make some changes to the earlier set, most notably to amend the duties placed on Ofcom, the regulator. The House of Lords Secondary Legislation Scrutiny Committee has raised some concerns about the UK’s ability to tackle online harm now that the UK has left the EU.

    HGV drivers: temporary relaxation of driving hours limits and minimum rest period rules

    Due to concerns about disruptions to supply chains resulting from Brexit and the coronavirus pandemic, the Government has introduced the Drivers’ Hours and Tachographs (Temporary Exceptions) Regulations 2021 (SI 2021/58) to relax the rules governing maximum driving hours and minimum rest periods. It has stated that the exceptions should only be used where necessary and not at the expense of safety. The House of Lords is due to debate the regulations on 18 March 2021.

    Relations between the UK and the EU entered a new phase in 2021, following the end of the Brexit transition period and the agreement of the Trade and Cooperation Agreement. While those negotiations are now over, UK-EU relations remain of significant policy interest. This article looks at opportunities for the House of Lords to scrutinise the new relationship through committee activity, post-legislative scrutiny, holding ministers to account and interparliamentary cooperation.

    Fast tracked planning permission to use land as temporary inland border facilities

    The Town and Country Planning (Border Facilities and Infrastructure) (EU Exit) (England) Special Development Order 2020 (SI 2020/928) has sped up the planning process for land to be used as inland border facilities in specified areas of England. The Government stated this is necessary due to the increased border control measures needed now the UK has left the EU. On 11 February 2021, the House of Lords will debate a motion ‘regretting’ the legislation.

    The Pacific Alliance is a regional integration initiative between Chile, Colombia, Mexico and Peru. In June 2019, the House of Lords International Relations Committee published a report calling for increased UK engagement with the bloc. The report is due to be debated in the House of Lords on 1 February 2021.

    Impact of Brexit on UK musicians performing in the EU

    Following the end of the transition period with the EU, UK musicians can no longer travel and work freely across the EU. In some countries, such as Spain and Germany, musicians will have to apply for a work permit if they want to be paid for performances. The EU and the UK have both said that they put forward proposals to prevent this outcome, but they could not come to an agreement.

    ‘Global Britain’ and the British Armed Forces

    The Government has used the phrase ‘Global Britain’ since the EU referendum in 2016 to summarise its post-Brexit foreign policy. It has said the Integrated Security, Defence and Foreign Policy Review, set to conclude early this year, will expand on its vision for the UK’s place in the world. In November 2020, Prime Minister Boris Johnson announced the first outcome of this review would be an increase in defence spending over the current parliament.

    UK-EU Trade and Cooperation Agreement

    On 24 December 2020, the UK and the EU reached agreement on a Trade and Cooperation Agreement (the TCA) setting out their future relationship. The UK Parliament passed the European Union (Future Relationship) Act 2020 in one day on 30 December 2020. The TCA has been provisionally applied by both parties from 1 January 2021. The House of Lords is due to debate the TCA on 8 January 2021.
